Aberratio ictus

Aberratio ictus (a misdirected blow) describes the situation in which the offender correctly identifies and aims at the intended object, but the result materialises on a different object of equal standing in law, because the causal course deviates, as where a shot fired at A hits B beside him. It must be distinguished from error in obiecto, where the offender confuses the object and the mistake is in principle irrelevant. The prevailing doctrine punishes it as an attempt on the intended object, concurrently with negligent commission as to the object actually hit, if the result there was foreseeable.

Aberratio ictus 0003-de
Aberratio ictus (Fehlgehen der Tat) bezeichnet die Konstellation, in welcher der Täter das anvisierte Objekt zwar richtig erkennt und ansteuert, der Erfolg aber infolge eines abweichenden Kausalverlaufs an einem anderen, tatbestandlich gleichwertigen Objekt eintritt, etwa wenn der auf A abgegebene Schuss den daneben stehenden B trifft. Abzugrenzen ist der Error in obiecto, bei dem der Täter das Objekt verwechselt und der Irrtum grundsätzlich unbeachtlich bleibt. Nach herrschender Lehre ist beim Fehlgehen der Tat wegen Versuchs am anvisierten Objekt zu bestrafen, in Idealkonkurrenz mit fahrlässiger Tatbegehung am tatsächlich getroffenen Objekt, sofern der dortige Erfolg voraussehbar und vermeidbar war.
