Action for possession

The action for possession rights (Fahrnisklage) is directed against every owner, regardless of whether he or she exercises independent or dependent possession. The cause of action lies either in the plaintiff's involuntary loss of possession or in the bad faith of the defendant.

Die Besitzrechtsklage (Fahrnisklage) richtet sich gegen jeden Besitzer, gleichgültig ob er selbständigen oder unselbständigen Besitz ausübt. Der Klagegrund liegt entweder im unfreiwilligen Besitzesverlust des Klägers oder im bösgläubigen Besitz des Beklagten.
