A circumvention of the law is defined as an attempt to achieve a similar legal or economic success through the conclusion of a legal transaction that is permitted in itself, as would result from a prohibited legal transaction.

Als Gesetzesumgehung bezeichnet man den Versuch, wenn man durch den Abschluss eines an sich erlaubten Rechtsgeschäftes einen ähnlichen rechtlichen respektive wirtschaftlichen Erfolg erreichen will, wie er sich als Folge eines verbotenen Rechtsgeschäftes ergeben würde.
