Condiciones in praeteritum are non-actual conditions in which the effect of a legal transaction is made dependent not on a future, but on a past or present circumstance, i.e. one that has in fact already been decided.

Condiciones in praeteritum sind uneigentliche Bedingungen, bei denen die Wirkung eines Rechtsgeschäfts nicht von einem zukünftigen, sondern einem in der Vergangenheit oder Gegenwart liegenden, also in Wirklichkeit bereits entschiedenen Umstand abhängig gemacht wird.
