A crime of condition exists if the criminal conduct comes to an end with the achievement of the criminal success and also a maintenance of the condition created thereby does not take place, but this condition continues of its own accord as an illegal condition.

Ein Zustandsverbrechen liegt vor, wenn mit der Herbeiführung des verbrecherischen Erfolges das deliktische Verhalten zu Ende ist und auch ein Aufrechterhalten des hierdurch geschaffenen Zustandes nicht stattfindet, dieser Zustand aber als rechtswidriger von selbst fortdauert.
