The Constitution in the formal sense is the totality of all legal acts enacted in its particular form of constitutional legislation. This constitutional concept is based exclusively on the form of the legal norm, the content is not relevant. This is in contrast to the constitutional concept in the material sense. Here, the content of the legal norms is taken into account and includes all those legal provisions which, because of their substantive implications, deserve to be included in the constitution.

Die Verfassung im formellen Sinne ist die Gesamtheit aller Rechtssätze, die in der besonderen Form der Verfassungsgesetzgebung erlassen worden sind. Es wird bei diesem Verfassungsbegriff ausschliesslich auf die Form der Rechtsnorm abgestellt, der Inhalt ist nicht relevant. Dies im Gegensatz zum Verfassungsbegriff im materiellen Sinne. Hier wird auf den Inhalt der Rechtsnormen abgestellt; er umfasst alle diejenigen Rechtssätze, die es wegen ihrer inhaltlichen Tragweite verdienen, in die Verfassung aufgenommen zu werden.
