Conversion of the legal transaction

The conversion of the legal transaction is the coming into effect of the unintentional form-free transaction, if the intended purpose is achieved as well as by the (void) transaction requiring form and it is to be assumed that the parties were more interested in the purpose than in the means.

Die Konversion des Rechtsgeschäfts ist das Wirksamwerden des an sich nicht gewollten formfreien Geschäfts, wenn der angestrebte Zweck ebenso erreicht wird wie durch das (nichtige) formbedürftige Geschäft und anzunehmen ist, den Parteien sei es mehr am Zweck als gerade am Mittel gelegen gewesen.
