Culpa compensation

A strongly predominant contributory negligence (contributory cause, not necessary by illegal, also by disorderly or in casu incorrect behaviour) of the injured party excludes the obligation to pay damages and, in case of evenly distributed negligence, transfers half of the damage.

Ein stark überwiegendes Mitverschulden (Mitverursachung, nicht notwendig durch rechtswidriges, auch durch ordnungswidriges oder in casu unrichtiges Verhalten) des Verletzten schliesst die Schadenersatzpflicht aus und verlegt bei gleichmässigem Verschulden den Schaden hälftig.
