The commission agent who takes over the del credere is liable for punctual fulfilment of the third party with whom he has concluded the execution transaction; he assumes the risk of the quality but not of the existence of the claim acquired for the account of the principal.

Der Kommissionär, der das del credere übernimmt, haftet für pünktliche Erfüllung des Dritten, mit dem er das Ausführungsgeschäft abgeschlossen hat; er übernimmt die Gefahr der Güte, aber nicht des Bestandes der auf Rechnung des Kommittenten erworbenen Forderung.
