Derogatory force

The derogatory force of federal law is the customary principle, developed in undisputed practice since 1848, that federal law breaks cantonal law. There can therefore be no valid cantonal law that contradicts federal law.

Die derogatorische Kraft des Bundesrechts ist der gewohnheitsrechtliche, seit 1848 in unbestrittener Praxis entwickelte Grundsatz, dass das Bundesrecht kantonales Recht bricht. Es kann somit kein gültiges kantonales Recht geben, das mit Bundesrecht im Widerspruch steht.
