The rights of representation confer by force or by law the power to bring about a change in the rights of domination. They are thus unilateral declarations of intent which must be received. Rights of formation, which can only be exercised by means of a court action, are called rights of formation action.

Gestaltungsrechte 0386-de
Die Gestaltungsrechte verleihen per Kraft oder Gesetz die Befugnis, eine Änderung der Herrschaftsrechte herbeizuführen. Es handelt sich somit um einseitige, empfangsbedürftige Willenserklärungen. Gestaltungsrechte, welche nur mittels einer gerichtlichen Klage ausgeübt werden können, heissen Gestaltungsklagerechte.
