are prerequisites for deviation from constant practice: The amended interpretation of a particular legal provision must be the result of a serious and thorough recent examination of the question and must be based on grounds which, according to general rules of interpretation, are capable of supporting the assumption that the real intention of the law is different from that which has been assumed so far, i.e. an error of interpretation.

Voraussetzungen zur Abweichung von der konstanten Praxis sind: Die geänderte Auslegung einer bestimmten gesetzlichen Vorschrift muss das Ergebnis einer ernsthaften, gründlichen neueren Untersuchung der Frage darstellen und sich auf Gründe stützen, die nach allgemeinen Auslegungsregeln geeignet sind, die Annahme, dass der wirkliche Wille des Gesetzes ein anderer sei, als der bisher angenommene, d. h. eines Irrtums in der Auslegung, stützen zu können.
