The essence of fiduciary property is that, in addition to a serious contribution in kind, an equally serious agreement under the law of obligations restricting the use of the transferred right is also involved, i.e. the external and internal relationship fall apart.

Das Wesen des fiduziarischen Eigentums besteht darin, dass neben einer ernstgemeinten dinglichen Zuwendung eine ebenso ernstgemeinte, die Ausnutzung des übertragenen Rechts einschränkende obligationenrechtliche Abmachung einhergeht, also äusseres und inneres Verhältnis auseinanderfallen.
