Eine Lücke intra legem liegt dann vor, wenn das Gesetz zwar auf eine bestimmte Rechtsfrage eine Antwort bereithält, diese Antwort aber noch nicht unmittelbar zur Lösung des konkreten Rechtsproblems führt, es vielmehr noch weiterer Abklärungen und Wertungen zur Gesetzesergänzung bedarf.
