Incapacity to act
0411-en RE320 Civil Code (ZGB) As of 11.07.2026
A person lacks capacity to act if he or she is not of age, lacks the capacity of judgement or is subject to a general deputyship (Art. 17 CC). Persons lacking capacity to act but capable of judgement, notably minors capable of judgement, have limited capacity: they may incur obligations only with the consent of their legal representative, but acquire gratuitous benefits independently and act freely within the scope of earnings left to them (Art. 19 et seq. CC).

Handlungsunfähigkeit 0411-de
Handlungsunfähig ist, wer nicht volljährig oder nicht urteilsfähig ist oder unter umfassender Beistandschaft steht (Art. 17 ZGB). Urteilsfähige handlungsunfähige Personen, namentlich urteilsfähige Minderjährige, sind beschränkt handlungsfähig: Sie können Verpflichtungen nur mit Zustimmung des gesetzlichen Vertreters eingehen, erwerben unentgeltliche Vorteile jedoch selbständig und handeln im Rahmen des ihnen überlassenen Arbeitserwerbs frei (Art. 19 ff. ZGB).
