Insult

Insult is the injury to the social standing of the individual according to his private, professional and public position. Swiss criminal law protects honour in particular through the offences of defamation, calumny and verbal abuse (Art. 173 et seq. SCC); verbal abuse covers the expression of contempt as a pure value judgment, without the assertion of dishonouring facts.

Die Beleidigung ist die Verletzung der sozialen Geltung des Einzelnen nach Massgabe seiner privaten, beruflichen und öffentlichen Stellung. Das schweizerische Strafrecht schützt die Ehre namentlich durch die Tatbestände der üblen Nachrede, der Verleumdung und der Beschimpfung (Art. 173 ff. StGB); die Beschimpfung erfasst dabei die Kundgabe der Missachtung als reines Werturteil, ohne Behauptung ehrenrühriger Tatsachen.
