There is genuine competition between laws if the legislator has established one and the same norm in different criminal laws and has dealt with the infringement against it in a special form and execution and then in each law pronounces a threat of punishment in respect of the same norm.

Eine echte Gesetzeskonkurrenz liegt vor, wenn der Gesetzgeber ein und dieselbe Norm in verschiedenen Strafgesetzen aufstellt und die Zuwiderhandlung gegen sie in besonderer Gestaltung und Ausführung behandelt hat und dann in jedem Gesetz eine Strafdrohung bezüglich derselben Norm ausspricht.
