Under the principle of criminal legality, the prosecuting authority (public prosecutor's office) is obliged to intervene in the case of official offences or on application for all acts punishable and punishable by law, provided there is sufficient factual evidence.

Im Rahmen des strafrechtlichen Legalitätsprinzips ist die Anklagebehörde (Staatsanwaltschaft) verpflichtet, bei Offizialdelikten oder auf Antrag wegen aller gerichtlich strafbaren und verfolgbaren Handlungen einzuschreiten, sofern zureichende tatsächliche Anhaltspunkte vorliegen.
