Peremptorization

Peremptorisation (default proceedings) is the summonsing of a party under the threat that otherwise the order or judgment will be made on the basis of the unilateral submission of the other party or on the basis of the files. The actual submissions of the party that appeared are thus deemed to be true, those of the disobedient party, if disputed, are deemed to be withdrawn.

Peremptorisierung 0606-de
Die Peremptorisierung (Säumnisverfahren) ist die Vorladung einer Partei unter der Androhung, dass sonst die Verfügung oder das Urteil auf den einseitigen Vortrag der Gegenpartei oder auf Grund der Akten erfolgt. Das tatsächliche Vorbringen der erschienenen Partei wird somit als wahr, die der ungehorsamen Partei, soweit bestritten resp. als zurückgezogen angenommen.
