In the event of a real gap, the law does not provide an answer to a legal question which would need to be answered. A decision can only be made by means of a legal amendment, since no decision can be made on the basis of the genuine gap.

Bei einer echten Lücke gibt das Gesetz auf eine Rechtsfrage, welche beantwortet werden müsste, keine Antwort. Eine Entscheidung ist erst durch eine Gesetzesergänzung möglich, da aufgrund der echten Lücke keine Entscheidung getroffen werden kann.
