The source under property law is not only present where water from a groundwater stream or an underground water vein emerges to the surface of its own accord, without human intervention; rather, any water vein rising from the groundwater or flowing underground, provided it is only permanent in character, can become a source by being cut, captured and discharged somewhere.

Die sachenrechtliche Quelle liegt nicht nur dort vor, wo Wasser aus einem Grundwasserstrom oder einer unterirdischen Wasserader von selber, ohne menschliche Vorkehren, an die Oberfläche austritt; vielmehr kann jede aus dem Grundwasser aufsteigende oder unterirdisch fliessende Wasserader, sofern sie nur dauernden Charakter hat, dadurch zur Quelle werden, dass sie angeschnitten, gefasst und irgendwohin abgeleitet wird.
