The speciality (apparent or false competition of laws) exists if several norms come together in such a way that one of them conceptually includes the other because the latter only covers a special case of it, but that only the special regulation wants to apply to this special case and therefore supersedes the general norm.

Die Spezialität (scheinbare oder unechte Gesetzeskonkurrenz) liegt vor, wenn mehrere Normen in der Weise zusammentreffen, dass die eine zwar begrifflich die andere mitumfasst, weil diese nur einen besonderen Fall von ihr ergreift, dass aber eben für diesen besonderen Fall nur die Sonderregelung gelten will, und daher die allgemeine Norm verdrängt.
