Substantive law

Substantive law comprises the legal norms that establish the rights and duties of legal subjects; it governs the creation, content and extinction of rights and legal relationships, such as claims, rights in rem and status rights. It is contrasted with procedural (formal) law, which orders the organisation, competence and procedure of the authorities for the enforcement of substantive law.

Das materielle Recht umfasst die Rechtsnormen, welche die Rechte und Pflichten der Rechtsgenossen festlegen; es regelt Entstehung, Inhalt und Untergang von Rechten und Rechtsverhältnissen, etwa von Forderungen, dinglichen Rechten und Statusrechten. Ihm steht das formelle Recht gegenüber, das Organisation, Zuständigkeit und Verfahren der Behörden zur Durchsetzung des materiellen Rechts ordnet.
