Appeal in cassation

The appeal in cassation to the Federal Supreme Court is admissible against cantonal second-instance main judgments and such first-instance judgments that are not subject to appeal under cantonal law, as well as against negative decisions by a last-instance cantonal referral authority and decisions on jurisdiction by cantonal courts; against judgments by the jury, although conceivable, is illusory due to lack of motivation.

Die Kassationsbeschwerde an das Bundesgericht ist zulässig gegen kantonale zweitinstanzliche Haupturteile und solche erstinstanzlichen Urteile, die kantonalrechtlich der Berufung nicht unterliegen, ferner auch gegen ablehnende Entscheide einer letztinstanzlichen kantonalen Überweisungsbehörde und Kompetenzentscheide kantonaler Gerichte; gegen schwurgerichtliche Urteile zwar denkbar, aber wegen Nichtmotivierung illusorisch.
