The Federal Act on Banks and Savings Banks of 1934 was the response to the banking crisis of the Great Depression, in which several major banks had to be restructured. For the first time it placed banks under state supervision by the Federal Banking Commission, required capital and liquidity, and in Art. 47 created the criminally enforced protection of banking secrecy. Much amended, the Act remains in force today; supervision passed to FINMA in 2009.

Das Bundesgesetz über die Banken und Sparkassen von 1934 war die Antwort auf die Bankenkrise der Weltwirtschaftskrise, in der mehrere Grossbanken sanierungsbedürftig wurden. Es unterstellte die Banken erstmals einer staatlichen Aufsicht durch die Eidgenössische Bankenkommission, verlangte Eigenmittel und Liquidität und schuf mit Art. 47 den strafrechtlich bewehrten Schutz des Bankgeheimnisses. Das Gesetz gilt, vielfach revidiert, bis heute; die Aufsicht ging 2009 an die FINMA über.
