Cartel Act

The Federal Act on Cartels and other Restraints of Competition seeks to prevent the economically or socially harmful effects of cartels and of undertakings with market power. The Act of 1995, revised in 2003, presumes hard-core price, quantity and territorial agreements to be unlawful, provides for direct sanctions of up to 10 per cent of turnover, and offers leniency for self-reporting. It is enforced by the Competition Commission, whose decisions may be appealed to the Federal Administrative Court and the Federal Supreme Court.

Das Bundesgesetz über Kartelle und andere Wettbewerbsbeschränkungen bezweckt, volkswirtschaftlich oder sozial schädliche Auswirkungen von Kartellen und marktmächtigen Unternehmen zu verhindern. Das Gesetz von 1995, revidiert 2003, vermutet die Unzulässigkeit harter Preis-, Mengen- und Gebietsabreden, kennt direkte Sanktionen bis 10 Prozent des Umsatzes und eine Bonusregelung für Selbstanzeigen. Vollzugsbehörde ist die Wettbewerbskommission; ihre Entscheide unterliegen der Beschwerde ans Bundesverwaltungsgericht und ans Bundesgericht.
