The expression denotes the pervasive presence, until the 1990s, of price, territorial and terms-of-trade cartels in the Swiss economy, tolerated by law and politics. Cartels were regarded as a factor of order and as protection for small business; the Cartel Act of 1962 did not prohibit them but subjected them to abuse control. The consequences were high prices, low productivity in the domestic market and a lack of competitive pressure. Only the revised Cartel Act of 1995, with its prohibition of hard-core agreements, broke the pattern.

Der Ausdruck bezeichnet die bis in die 1990er-Jahre verbreitete Durchsetzung der schweizerischen Wirtschaft mit Preis-, Gebiets- und Konditionenkartellen, die von Recht und Politik geduldet wurden. Kartelle galten als Ordnungsfaktor und Schutz des Gewerbes; das Kartellgesetz von 1962 verbot sie nicht, sondern unterstellte sie einer Missbrauchskontrolle. Die Folge waren hohe Preise, tiefe Produktivität im Binnenmarkt und mangelnder Wettbewerbsdruck. Erst das revidierte Kartellgesetz von 1995 mit dem Verbotsprinzip für harte Abreden brach das Muster.
