0138-en RE320 Civil Code (ZGB) As of 11.07.2026
Civil building law is an easement on third-party land and grants the basically transferable and hereditary right to build or maintain a building on the land which legally appears to be part of the third-party land or is considered to be independent. The building right can be entered in the land register.

Das zivilrechtliche Baurecht ist eine Dienstbarkeit an fremden Grundstücken und gewährt das grundsätzlich übertragbare und vererbliche Recht, auf der Bodenfläche ein Bauwerk zu errichten oder beizubehalten, das rechtlich als Bestandteil des fremden Bodens erscheint oder eigenständig betrachtet wird. Das Baurecht kann im Grundbuch eingetragen werden.
