Civil servitudes
0750-en RE320 Civil Code (ZGB) As of 11.07.2026
State servitudes (servitudes under international law) are restrictions on the territorial sovereignty of one State in favour of another and consist either in an obligation to a non facere, namely that the serving State renounces the exercise of a certain sovereign power on its territory, or in faciendo, in that the serving State must tolerate acts of the entitled State on its territory.

Staatsdienstbarkeiten (völkerrechtliche Servituten) sind Beschränkungen der Gebietshoheit eines Staates zugunsten eines andern und bestehen entweder in der Verpflichtung zu einem non facere, nämlich darin, dass der dienende Staat auf die Ausübung einer bestimmten Hoheitsbefugnis auf seinem Gebiet verzichtet, oder in faciendo, indem der dienende Staat auf seinem Gebiet Handlungen des berechtigten Staates dulden muss.
