The claim is the right to demand performance from the opponent under the obligation (as a relative right) or under absolute, real or finally under absolute and relative rights of civil law. Even in the Code of Obligations, the claim and the demand are not necessarily identical.

Der Anspruch ist das aus dem Schuldverhältnis (als relativem Recht) oder aus absoluten, dinglichen, oder endlich aus absoluten und relativen Rechten des Zivilgesetzes fliessende Recht, vom Gegner die Leistung zu verlangen. Anspruch und Forderung sind auch im Obligationenrecht nicht zwingend identisch.
