The military order is the declaration of will solely related to the military service and based on the duty of obedience. The unlawful order has no binding force and can therefore only be a reason for excuse. This, because the person entitled to give the order cannot override the legal system.

Der militärische Befehl ist die allein auf den militärischen Dienstbereich bezogene und gestützt auf die Gehorsamspflicht fordernde Willenserklärung. Der rechtswidrige Befehl hat keine bindende Kraft und kann daher nur Entschuldigungsgrund sein. Dies, da der zur Befehlserteilung Berechtigte die Rechtsordnung nicht ausser Kraft setzen kann.
