Collective labour agreement

The collective labour agreement under Art. 356 et seq. of the Code of Obligations is an agreement between employers or their associations and employee associations on the conclusion, content and termination of individual employment relationships. Its normative provisions apply directly and mandatorily to the contracts within its scope. The Federal Council may declare an agreement generally binding and thus extend it to a whole sector. In Switzerland about half of all employees are covered by such an agreement; it is the central instrument of social partnership and also serves to combat wage dumping.

Der Gesamtarbeitsvertrag nach Art. 356 ff. OR ist die Vereinbarung zwischen Arbeitgebern oder deren Verbänden und Arbeitnehmerverbänden über Abschluss, Inhalt und Beendigung der Einzelarbeitsverhältnisse. Seine Normativbestimmungen wirken unmittelbar und zwingend auf die unterstellten Arbeitsverträge. Der Bundesrat kann einen Vertrag für allgemeinverbindlich erklären und damit auf eine ganze Branche ausdehnen. In der Schweiz sind rund die Hälfte der Arbeitnehmenden einem Gesamtarbeitsvertrag unterstellt; er ist das zentrale Instrument der Sozialpartnerschaft und dient auch der Bekämpfung von Lohndumping.
