The discovery is the recognition of given connections. The discovery does not define a new rule for technical action (as the invention does), but shows something pre-existing. The discovery thus lacks the final character of action and is therefore not patentable in itself. However, the discovery can form the basis for a patentable invention.

Entdeckung 0304-de
Die Entdeckung ist das Erkennen vorgegebener Zusammenhänge. Die Entdeckung definiert keine neue Regel zum technischen Handeln (wie das die Erfindung tut), sondern zeigt etwas Vorbestehendes auf. Der Entdeckung fehlt somit der finale Handlungscharakter und sie ist deshalb für sich gesehen patentrechtlich nicht schutzfähig. Die Entdeckung kann aber die Grundlage für eine patentrechtlich schutzfähige Erfindung bilden.
