The civil law requirement is the ancillary provision associated with a gratuitous benefit, which, according to the recipient, is obliged to provide a benefit for a specific purpose. In particular, the condition under inheritance law is a disposition on account of death, which imposes on a person the obligation to do or not to do something for a specific purpose, without giving rise to a right of claim on the part of a beneficiary.

Die zivilrechtliche Auflage ist die mit einer unentgeltlichen Zuwendung verbundene Nebenbestimmung, der gemäss dem Empfänger zu einer Leistung zu einem bestimmten Zweck verpflichtet wird. Insbesondere die erbrechtliche Auflage ist eine Verfügung von Todes wegen, durch welche einer Person die Verpflichtung auferlegt wird, zu einem bestimmten Zwecke etwas zu tun oder zu lassen, ohne dass einem Begünstigten ein diesbezügliches Forderungsrecht erwächst.
