Falsus procurator

The falsus procurator is the pseudo-representative who pretended to be the authorized representative towards the third party without being it. It is therefore acting on behalf of a third party under the pretence of the existence of a power of attorney which does not exist in reality.

Der falsus procurator ist der Pseudovertreter, der sich dem Dritten gegenüber als bevollmächtigter Vertreter ausgab, ohne es zu sein. Es ist somit ein Handeln in fremdem Namen unter der Vorgabe des Bestehens einer Vollmacht, die in Wirklichkeit nicht existiert.
