Family Fideicommissum
0331-en RE320 Civil Code (ZGB) As of 11.07.2026
The Family Fideicommissum is defined as a special property without legal personality, which is consolidated and administered by the fideicommissioner in a limited ownership position, may neither be sold nor encumbered, is dedicated to a special ideal and also material family purpose and follows a fixed original succession under family and inheritance law in order to protect against fragmentation of the property.

Definiert wird das Familienfideikommiss als ein Sondervermögen ohne Rechtspersönlichkeit welches durch den Fideikommissar in einer beschränkten Eigentümerstellung gefestigt und verwaltet wird, weder veräussert noch belastet werden darf, einem besonderen ideellen und auch materiellen familiären Zweck gewidmet ist und zum Schutz vor Zersplitterung des Besitzes einer festgesetzten originären familien- und erbrechtlichen Sukzession folgt.
