Formal law is understood to be those norms that regulate the organisation, competence and procedure of the authorities. Formal law is thus addressed to the state authorities and regulates their responsibilities in the process of legislation and application of the law.

Unter dem formellen Recht versteht man diejenigen Normen, welche die Organisation, die Zuständigkeit sowie das Verfahren der Behörden regelt. Das formelle Recht richtet sich somit an die Staatsorgane und regelt deren Zuständigkeiten bei der Rechtssetzung und bei der Rechtsanwendung.
