The law requires a certain form to be observed for certain legal transactions. This is justified by the protection against overreaching, the desire for clear evidence and also as a basis for keeping a public register.

Das Gesetz verlangt für bestimmte Rechtsgeschäfte die Einhaltung einer bestimmten Form. Begründet wird dies mit dem Schutz vor Übervorteilung, den Wunsch nach einer klaren Beweislage und auch als Grundlage zur Führung eines öffentlichen Registers.
