Fraud (Art. 146 SCC) is the deceitful deception by which the offender, with intent to obtain an unlawful enrichment, creates or reinforces an error and thereby induces the person in error to conduct that damages his own or another's assets. The core of the offence is deceit (Arglist): simple lies do not suffice; special machinations, an edifice of lies or the exploitation of the victim's inability to verify the statements are required.

Der Betrug (Art. 146 StGB) ist die arglistige Täuschung, durch die der Täter in der Absicht unrechtmässiger Bereicherung einen Irrtum erregt oder bestärkt und den Irrenden dadurch zu einem Verhalten bestimmt, mit dem dieser sich selbst oder einen andern am Vermögen schädigt. Kern des Tatbestands ist die Arglist: Einfache Lügen genügen nicht; verlangt sind besondere Machenschaften, ein Lügengebäude oder die Ausnützung der fehlenden Überprüfbarkeit der Angaben.
