0659-en RE320 Civil Code (ZGB) As of 11.07.2026
The property-law legal possession of rights (possession of rights) as an extending exception to the concept of possession as dominion over property is only known under civil law in the case of easements and land charges, in that the ZGB equates the actual exercise of the right with property.

Der sachenrechtliche Rechtsbesitz (Besitz an Rechten) als erweiternde Ausnahme vom Besitzbegriff als Sachherrschaft kennt das Zivilrecht nur bei Grunddienstbarkeiten und Grundlasten, indem das ZGB die tatsächliche Ausübung des Rechtes dem Sachbesitz gleichstellt.
