A gap in the law is understood to be the absence of a necessary legal order. The law does not provide an answer to a specific legal question or does not provide a direct answer. There is a gap in the law which can be filled by means of customary law.

Unter einer Gesetzeslücke versteht man das Fehlen einer erforderlichen gesetzlichen Anordnung. Auf eine bestimmte Rechtsfrage lässt sich dem Gesetz keine Antwort oder nicht unmittelbar eine Antwort entnehmen. Es liegt eine Lücke im Gesetz vor, die mittels Gewohnheitsrechts zu füllen ist.
