Mandatory legal norms are those which are beyond the will of the parties and therefore cannot be changed by them. A distinction is made between the absolutely mandatory legal norms (these may not be changed at all) and the relatively mandatory legal norms, which may only be changed in favour of a certain party (usually the socially weaker party).

Zwingendes Recht 0883-de
Zwingende Rechtsnormen sind solche, welche dem Willen der Parteien entzogen sind und von diesen somit nicht abgeändert werden können. Man unterscheidet die absolut zwingenden Rechtsnormen (diese dürfen überhaupt nicht abgeändert werden) und die relativ zwingenden Rechtsnormen, welche nur zugunsten einer bestimmten Partei (meist die sozial schwächere Partei) abgeändert werden dürfen.
