Mental reservation

The mental reservation as a lack of will means that a contracting party wants to (make) the declaration but not its content. At the time of the expression of will, the person making the declaration is fully aware that it does not correspond to his or her decision. The declaration is binding on the bona fide third party.

Die Mentalreservation als Willensmangel besagt, dass ein Vertragsschliessenden zwar die Erklärung (machen) will, aber nicht deren Inhalt. Der Erklärende ist sich im Zeitpunkt der Willensäusserung voll bewusst, dass diese seinem Willensentschluss nicht entspricht. Die Erklärung ist gegenüber dem gutgläubigen Dritten verbindlich.
