0299-en RE330 Code of Obligations (CO, General/Special Part) As of 11.07.2026
The plea serves, like the plea, to defend a right that has been asserted. With an objection, the debtor presents facts that are contrary to the creditor's right. A distinction can be made between facts that prevent the right and facts that set aside the right. The judge must consider such facts ex officio as soon as they are included in the subject matter of the case.

Die Einwendung dient wie auch die Einrede der Abwehr eines geltend gemachten Rechts. Mit einer Einwendung bringt der Schuldner Tatsachen vor, die dem Recht des Gläubigers entgegenstehen. Man kann die rechtshindernden Tatsachen und die rechtsaufhebenden Tatsachen unterscheiden. Der Richter muss solche Tatsachen von Amtes wegen berücksichtigen, sobald sie in den Prozessstoff eingefügt worden sind.
