Presumption of jurisdiction

The presumption of competence in favour of the cantons means that all state tasks which the Federal Constitution does not assign to the Confederation remain with the cantons (Art. 3 Federal Constitution): the cantons are sovereign insofar as their sovereignty is not limited by the Federal Constitution, and they exercise all rights not delegated to the Confederation.

Zuständigkeitsvermutung 0880-de

Die Zuständigkeitsvermutung zugunsten der Kantone besagt, dass alle Staatsaufgaben, welche die Bundesverfassung nicht dem Bund zuweist, bei den Kantonen verbleiben (Art. 3 BV): Die Kantone sind souverän, soweit ihre Souveränität nicht durch die Bundesverfassung beschränkt ist, und üben alle Rechte aus, die nicht dem Bund übertragen sind.
