By presumption, the law assigns a certain meaning to human behaviour. This is independent of whether it really corresponds to the will of the contracting parties in the concrete case. The presumption thus focuses on the existence or non-existence of the facts, irrespective of the actual facts. A distinction can be made between rebuttable presumptions (with for proof of the contrary) and irrefutable presumptions (fictions). In the case of an irrefutable presumption, no proof to the contrary is admissible.

Vermutung 0837-de
Mit der Vermutung misst das Gesetz einem menschlichen Verhalten einen bestimmten Sinn zu. Dies unabhängig davon, ob er im konkreten Fall wirklich dem Willen der Vertragsparteien entspricht. Die Vermutung stellt so unabhängig vom wirklichen Sachverhalt auf das Vorhandensein oder Nichtvorhandensein von den Tatsachen ab. Es können die widerlegbaren Vermutungen (mit zum Beweis des Gegenteils) und die unwiderlegbaren Vermutungen (Fiktionen) unterschieden werden. Bei der unwiderlegbaren Vermutung ist kein Beweis des Gegenteils zugelassen.
