State of emergency

A state of emergency is a collision of legitimate interests, whereby one legal interest is to be saved at the expense of the other. In the case of a state of emergency to save the predominant, in particular higher interest, it should be possible to sacrifice the lower interest.

Der Notstand ist eine Kollision rechtmässiger Interessen, wobei das eine Rechtsgut auf Kosten des andern gerettet werden soll. Bei einem Notstand zur Rettung des überwiegenden, insbesondere höheren Interesses soll das geringere Interesse geopfert werden können.
