Die Staatsanwaltschaft ist eine monokratische, von den Weisungen ihrer vorgesetzten Behörden abhängige Verwaltungsbehörde, die bei jedem Gericht bestehen muss. Die Staatsanwaltschaft hat nach dem Code Napoleon eine dreifache Funktion: a) die Vertretung der Staatsinteressen im Zivilprozess, b) die Vertretung der Anklage im Strafprozess und c) die Aufsicht über die Tätigkeit der Gerichte.

The Public Prosecutor's Office is a monocratic administrative authority, dependent on the instructions of its superior authorities, which must exist in every court. According to the Napoleonic Code, the public prosecutor's office has a threefold function: a) to represent the interests of the State in civil proceedings, b) to represent the prosecution in criminal proceedings and c) to supervise the activities of the courts.
