Agency contract

The agency contract is a sui generis contract by which the principal entrusts the agent on a permanent basis to act as an intermediary for this business or to conclude it on his behalf in return for remuneration (commission). In contrast to the service contract, it should be noted that there is no subordination relationship in the agency contract.

Der Agenturvertrag ist ein Vertrag sui generis, durch den der Agent vom Geschäftsherrn ständig damit betraut wird, gegen Vergütung (Provision) für diesen Geschäfts zu vermitteln oder in dessen Namen abzuschliessen. In Abgrenzung zum Dienstvertrag gilt es festzuhalten, dass es beim Agenturvertrag kein Unterordnungsverhältnis gibt.
