Agreement to mediate

The agreement to mediate is the contract between the parties and the mediator on the conduct of the mediation. It governs in particular the subject matter and procedure, confidentiality, involvement of third parties, fees and allocation of costs, limitation issues and termination of the process. Legally it is an innominate contract with elements of agency law (Art. 394 et seq. CO). It must be distinguished from the eventual outcome, the settlement agreement.

Mediationsvereinbarung 1043-de
Die Mediationsvereinbarung ist der Vertrag zwischen den Parteien und dem Mediator über die Durchführung der Mediation. Sie regelt namentlich Gegenstand und Ablauf, Vertraulichkeit, Beizug Dritter, Honorar und Kostenteilung, Verjährungsfragen sowie die Beendigung des Verfahrens. Rechtlich handelt es sich um einen Innominatvertrag mit auftragsrechtlichen Elementen (Art. 394 ff. OR). Sie ist vom späteren Ergebnis, der Abschlussvereinbarung, zu unterscheiden.
